Detailed overview

Start with the separate questions

Treated sewage sludge has been applied to agricultural land in Yuma County. Residents have complained about flies and odors, County and state inspections have documented different conditions, and Arizona has moved against five agricultural leases involving AgTech. Meanwhile, the City of Yuma has approved a separate biosolids service award with an estimated annual expenditure of $940,000.

These developments are part of the same controversy, but they do not establish the same things. The State's lease action does not settle the scientific questions, and the City's service award does not establish where the material was ultimately delivered.

This dossier brings together the government records, scientific research, public complaints and competing claims. It separates what the evidence establishes from what remains disputed or unanswered.

Biosolids and domestic septage are related but distinct materials. EPA generally uses “biosolids” for sewage sludge treated to meet federal requirements and intended for use as a soil amendment or fertilizer. Domestic septage is material removed from systems such as septic tanks and portable toilets that receive domestic sewage. The federal definition excludes commercial or industrial wastewater and restaurant grease-trap waste. Findings about one material should not automatically be applied to the other. The documented public actions

On December 1, 2025, the Yuma County Board of Supervisors asked the Arizona State Land Department to end AgTech's lease. The letter established the County's position, but did not itself terminate the lease.

On September 2, 2026, the Yuma City Council approved a biosolids service award with an estimated annual expenditure of $940,000. That was an authorization estimate, not evidence that the full amount had been paid.

Eight days later, Governor Katie Hobbs announced action against five State Trust Land agricultural leases involving AgTech. One lease was placed in default and four would not be renewed. The announcement did not establish a countywide biosolids ban.

These were three separate public actions. The records reviewed do not establish whether material handled under the City's arrangement reached the affected State Trust Land parcels, or whether either arrangement automatically determined the operating status of the other.

In her September 10 statement, Attorney General Kris Mayes said her office's investigation helped lead to the lease action and would continue. She described complaints about flies, odors and possible contamination from residents, growers and businesses. This is a dated account of the office's work, not an adjudicated contamination finding. KAWC reported AgTech's response: the company disputed the State's characterization and said it intended to challenge the action. A September 24 attorney letter now available for review makes AgTech's written position clear: it challenges the default and four nonrenewals, argues that notice-and-cure procedures were not followed, and asks the State Land Department for public clarification. It says a separate appeal is forthcoming. The letter copy does not prove delivery, a filed appeal, an agency response, or any ruling or relief.

What the lease action established

Concise chronology

The chronology distinguishes research dates from inspection and announcement dates. It includes the 2015 fly-pathogen report and 2018 presentation of 2017 fieldwork; the County's December 2025 lease request; County inspections on April 2–3, 2026 and the April 3 announcement; the April 9 ADEQ air inspection; and the July and September agency actions. It also records the September 25, 2026 update, when AgTech said its counsel submitted a formal written challenge but the attorney letter was not yet available for independent review. City spending and biosolids volumes

The City award is an annual estimate, not proof of payment. The Governor's release reports that AgTech applied more than 68,000 dry metric tons of treated sewage sludge in 2025, with more than 97% originating with California utilities. Those are State-reported figures, not independently audited shipment totals or City-only volumes. City award record; Governor's release.

Flies: observations are not interchangeable

Historical emergence-trap research, inspections and residents' complaints address different places, times and questions. The 2018 presentation reports a selected-site study in 2017; its chart measures average flies per square metre per day, not shares of Yuma's fly population. The County's April 2026 report records no larvae found during six site inspections. The April 9 ADEQ air report records substantial fly activity at field P. None supplies a representative attribution of the 2026 regional infestation. Limited non-detection does not prove a site could never contribute; residents' accounts document their experiences without independently identifying a breeding source.

The fly evidence and its limits

PFAS: general science and local evidence

The public science section explains occurrence, modeled risk and measured attenuation without transferring national or other-county findings into a Yuma conclusion. It does not establish AgTech as the source of contamination in a particular well or food crop. Local source material, sampling locations, controls, hydrology and exposure pathways would need to be connected.

An official action can be real without settling every allegation behind it. A company's disagreement can be vigorous without erasing the underlying evidence. The executed City agreement, payments, alternative-disposal quotes, parcel-level shipment records and lease instruments remain separate questions. The complaint and certificates remain unreviewed, so pleaded claims, actual service dates, liability, and outcome are unresolved.
